At the end of last year, the Moscow City Government, Moscow trade union associations and Moscow employers' associations signed the trilateral agreement setting out additional obligations of Moscow employers (the Agreement).
The Agreement provide for the new employers’ obligations for 2025-2027, including:
NB1: The Agreement applies both to companies and individual entrepreneurs operating in Moscow.
NB2: The Moscow Trilateral Commission for Settlement of Social and Labor Relations (the MTC) will control the Agreement abidance as well as amend its wording. In addition, any of the parties to the Agreement may check the fulfillment of the employers’ obligations by requesting documents or personal visits.
NB3: The Agreement also provides for the expansion/clarification of trade union rights, in particular, to exercise control over the payment deadlines, indexation, informing employees on labor protection and guarantees, etc.
NB4: The Agreement automatically applies to all Moscow employers and does not provide for the possibility of withdrawal. If you are not ready to take on additional responsibilities, we recommend sending an application to the MTC no later than February 13, 2025.
The Agreement provide for the new employers’ obligations for 2025-2027, including:
- collecting and analyzing of issues relevant to various sectors of the economy;
- products, works, services quality and safety assessing;
- creating conditions for raising the level of employees’ education;
- supporting measures for socially sensitive categories;
- applying the following criteria of mass dismissal and informing about the threat of mass dismissal at least 3 months in advance: (a) dismissal of more than 25% of employees within 30 calendar days, or (b) redundancy of (i) 50 or more employees within 30 calendar days, (ii) 200 or more employees within 60 calendar days, (iii) 500 or more employees within 90 calendar days;
- creating the dismissed employees with the additional education opportunities;
- preventing, in the event of redundancy, the simultaneous dismissal of spouses, parents, adoptive parents, guardians raising minor children and/or caring for disabled family members within 6 months;
- providing training at specialized educational centers for members of occupational safety committees and occupational safety commissioners.
